Looks like the Corporatistas, Protection of Medical Profits Division, is doing a nice job of shutting down a New England-based attempt to, gasp, put the privacy rights of patients and doctors over the Profit Rights of La Corpo: WaPo:

A federal judge has ruled that a new Maine law making doctors' prescription-writing habits confidential violates the Constitution.

U.S. District Judge John Woodcock concluded that the law, which was scheduled to take effect Jan. 1, would prohibit "the transfer of truthful commercial information" and "violate the free speech guarantee of the First Amendment."

Don'tcha love it? "Truthful commerical information" in this case means that the Corps have a right to know that your doctor prescribed you a nice cheap generic drug rather than the Latest Patent-Protected Most Profitable version, so they can threaten your doctor with various dire penalties the next time the Pharma Santa comes to town.

Ho, I say. Ho. And in the Don Imus sense, not the Claus-witzian. Profit-pocket-padded hos.

Note also that this seems to be connected to another law designed to drive small pharmacies out of business, by reimbursing them for Medicare drugs below market rates. Your small town pharmacy might have privacy qualms.

being as this happened in Maine, and then remembered that I can't remember if Bangor is the capital or not, and also that since this was a judicial ruling (not to mention just happened) there was not much opportunity for violent street action anyway.

And it's cold and all.

But as we work on our Anaconda Plan to get sane single-payer healthcare in this country, the problem of what to do about Big Pharma is a large part of this. They don't just game the rules that the Adam Smith types think runs how business works, they wrote the fucking rules in the first place and compete to see who can go further in stretching them.

I think though if we could get enough people to realize that Big Pharma=Big Brother sitting there with a camera and microphone in the supposedly sacrosanct doctor's examining room, they would be horrified. And the constant drumbeat of commercials for Montel Williams' Big Bus of Pharma Charity, helping Little Poor People one at a time get their drugs for "free", would have a reverse of the desired impact.

Ooh these people piss me off. "We have to charge these ludicrous prices to finance the research for the next generation of drugs!" is the biggest lie since "These lands will be yours as long as the grass grows and the river flows."

this has been another addition to You Don't Live in a Free Democracy of Laws, Nor Do You Have Any "Rights." the sooner people absorb that consciousness, the sooner we can begin to enact real change. shit like this will make more people have that mindset, that much i know.
