Evil comes cheap
ABC:
Two psychologists are responsible for designing the CIA's program of waterboarding suspected terrorists and for assuring the government the program was safe, according to an ABC News report.
Former military officers Bruce Jessen and Jim Mitchell had an "important role in developing what became the CIA's torture program," Jameel Jaffer, an attorney with the ACLU, told ABC News.
Good to have the names. Presumably their licenses to practie will be revoked?
Souter to retire?
It seems he hasn't hired any law clerks for the coming term.
Obama, in presser, flat out lies on state secrets privilege
[OBAMA] It can't be emphasized enough that this "state secrets" tactic was not ancillary to the Bush abuses; it was central to them. Secrecy is the linchpin, the key enabling weapon, of all government abuses. That's why Obama's embrace of the radical Bush position has been so deeply troubling. And the excuse Obama gave last night for why he has been doing this is simply inaccurate and misleading:
But keep in mind what happens, is we come in to office. We're in for a week, and suddenly we've got a court filing that's coming up. And so we don't have the time to effectively think through, what exactly should an overarching reform of that doctrine take? We've got to respond to the immediate case in front of us.
This just is not true. In each of the cases where the Obama DOJ embraced the Bush state secrets theory, the plaintiffs' lawyers were not only willing, but eager, to grant as much time as the Obama DOJ wanted in order for them to figure out what they should do. In response, Obama DOJ lawyers continuously indicated they needed no time, because they were convinced that they were right about the state secrets argument and had approval for their positions at the highest levels. When asked, Robert Gibbs explicitly said that Obama was consulted on the DOJ's positions in these cases and agreed entirely with them: "absolutely, absolutely he does."
Now, to be fair, Greenwald goes on to point out positive aspects of Obama's presser -- in particular, if torture is a crime, surely prosecution is called for?

Barack Obama, as the image conveys in the most luminous way, is a listener.
On health care, that's demonstrably not true.
Dems Doing Damnably Dumb Deed: 12 Voting against the mortgage cramdown measure
Update below with link for video of Sen. Durbin's post-vote remarks. Strong and pointed. Also, Scarecrow's take at FDL, and Snarlin' Arlen's first stab in the back of the Dems.
Today twelve Democratic senators, including the newest "Democratic" senator Arlen Specter, voted with all the Repubs to defeat the mortgage cramdown measure. Kennedy(MA) and Rockefeller (WV) were absent. Lieberman voted with the Dems on this (a freebie, since it was going down anyway?).
Mom's experience with Medicare part C
Just one anecdote, and a mild one at that. I know: the plural of "anecdote" is not "data". So take it as you will.
My Mom is enrolled via Medicare part C in an HMO whose name will be changed to protect the people working for it who bent the rules a bit. I'll refer to it as MPCHMO. Mom is mostly pretty much happy with MPCHMO. Bear that in mind as you read.
Mom recently found herself suffering from a bewildering array of vague symptoms which were reducing her quality of life dramatically. Age-related? She decided to check it out.

You may have heard of Hueco Tanks. Hueco Tanks is one of Texas' newest State Parks -- and among its most famous, having been profiled in a number of magazines including Southern Living. Climbing magazine online has this quote and image:
In the 1980s, Hueco Tanks earned an international reputation as a top rock-climbing spot, especially during mild winter months. In addition, a growing number of school groups from El Paso and throughout West Texas find the park to be an outstanding outdoor classroom.
Because of graffiti and other past damage to some of Hueco Tanks’ invaluable archeological treasures and its fragile desert ecosystem, park users’ access to the park has been limited in recent years in accordance with a public use plan. Park visitors must watch a 20-minute TPWD video that explains the history of Hueco Tanks, the importance of conserving its natural and cultural resources, and defines the park’s self-guided and guided-only areas.
The site used to be one of the world's most popular, and remains among the premier, destinations for rock climbers. These days -- as people often do, in previous years

people abused Hueco Tanks -- the fragile desert watering place with its connections to the past has tighter access controls, and some of them come from the climbers themselves:

John Cornyn's Swine Flu Update, vs. the CDC H1N1 Information
I sent a complaint letter to John Cornyn over something really outstandingly Cornynish awhile back, and now I regularly get his "updates" in my email.
For a multitude of reasons, I'm one of the voices speaking out to try and stop the panic about "pandemic" influenza. I'm also one of the people who's bemused by the rush to stop calling this "swine flu". (Can't help thinking John Soules Foods, Smithfield, Tyson et. al. are in on the rush to alter the nomenclature; cynical, I am.) So below I'm reproducing, as best I can (you'll need to imagine the "United States Senate" seal fading out through the print midpage) his latest missive. Then I'll add the link for what the CDC says about the flu outbreak. I'm also adding a little information about influenza surveillance in case you're interested. Decide for yourself if Sen. Cornyn is credible, eh?
Update from U.S. Senator John Cornyn Wednesday, April 29, 2009
Update on the H1N1 (Swine Flu) Virus
We are all concerned by recent developments regarding the H1N1 virus, commonly known as the swine flu, and particularly the sad news that the first casualty in the United States was a 23-month-old toddler from Mexico who had travelled to Texas with family. Because there is a lot of fear and misinformation out there, I wanted to take a moment to share with you some facts about the H1N1 flu outbreak and how Texans can best protect themselves.
Cases of the H1N1 flu, while predominantly affecting Mexico, have been confirmed in several states, including Texas. H1N1 viruses do not normally infect humans; however, sporadic human infections with swine flu occasionally do occur. The symptoms of this flu are similar to the symptoms of seasonal flu seen each year.
The H1N1 flu is spread through human contact, so washing your hands often and covering your mouth with a tissue when you sneeze or cough can help you stay healthy. Stay home if you are feeling sick, and avoid touching your eyes, nose or mouth. Heed the advice of your local public health officials.
I have talked with Texas Health Commissioner David Lakey, as well as Governor Rick Perry, who informed me that several local school districts along the border and near San Antonio have made the decision to proactively close several schools as a precautionary measure. As of right now, there are just three known severe cases of the H1N1 virus in the state of Texas.
I have also been briefed by Homeland Security Secretary Janet Napolitano on the situation and I remain in close contact with Homeland Security and federal health officials, along with state and local leaders in Texas. I stand ready to assist the Governor, Commissioner Lakey, and local leaders in any way that I can.

Sincerely,
U.S. Senator John Cornyn
